Agreement to terms
These Terms of Service ("Terms") govern your use of the Voorcap mobile application and website (the "Service"), operated by Synapeer Technologies, Inc. ("Company," "we," "us," or "our"), a Delaware corporation.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old to use Voorcap. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
Your account
You are responsible for maintaining the security of your account credentials. You must not share your login information with others. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at hello@voorcap.com.
User content
You retain ownership of all content you create and upload to Voorcap, including photos, videos, audio recordings, and text ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to store, transmit, and display your content as necessary to operate the Service — for example, delivering your Cap content to the intended recipient.
You are solely responsible for your User Content. You must not upload content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
- Infringes on the intellectual property rights of others
- Contains malware, viruses, or harmful code
- Is sexually explicit or exploitative, particularly involving minors
- Promotes violence, self-harm, or illegal activities
- Impersonates another person or entity
- Contains private information of others without their consent
We reserve the right to remove any User Content that violates these Terms, and to suspend or terminate accounts that repeatedly violate our policies.
Caps and location services
Voorcap uses GPS location data to pin Caps to physical coordinates and to verify that recipients are within proximity to open them. By using the Service, you consent to the collection of location data as described in our Privacy Policy.
You must not use Caps to:
- Lure, stalk, or harass individuals by directing them to unsafe locations
- Place Caps in restricted, private, or dangerous areas where others would need to trespass to access them
- Create misleading or fraudulent content designed to deceive recipients
Subscriptions and payments
Voorcap offers both free and paid subscription tiers. Paid subscriptions are billed through Apple App Store or Google Play Store. Subscription terms, pricing, and renewal policies are governed by the respective store's terms. You can cancel your subscription at any time through your device's subscription settings.
We reserve the right to change subscription pricing with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect.
Intellectual property
The Voorcap name, logo, brand identity, app design, and all associated visual assets are the property of Synapeer Technologies, Inc. You may not copy, modify, distribute, or create derivative works from our intellectual property without our written permission.
Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of GPS location data or the availability of specific features.
Limitation of liability
To the maximum extent permitted by law, Synapeer Technologies, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or personal injury.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Termination
We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately. Caps you have already sent may remain accessible to their recipients.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
Changes to these terms
We may update these Terms from time to time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
